RECKLESS DRIVING IN MICHIGAN- 6 points - 93 day jail Misdemeanor
Reckless Driving in Michigan, is defined as "driving on a highway, frozen public lake, or parking place; in wanton or willful disregard of the safety of persons or property. It is a criminal misdemeanor offense that stays on your record forever; penalties are high and suspension of your driver's license is mandatory through the Secretay of State.
Because a reckless driving charge is a criminal misdemeanor, the prosecutor must prove you guilty beyond a reasonable doubt for each and every element of the reckless driving charge (pursuant to the Michigan Jury Instructions).
Reckless Driving Can Be Challenged
The reckless driving statute in Michigan is very vague, and open to several interpretations. There are many Michigan cases which support and define the necessary elements of the offense of reckless driving. The Prosecution has a very high burden of proof to show that you had the 'wanton' or 'willful' disregard to the safety of persons or property while driving your vehicle. This can be challenged through a persuasive legal argument to the Judge or Jury. In most cases, a lesser included civil infraction offense is an option to a reckless driving charge in  most Michigan jurisdictions.
Therefore, do NOT simply just go to Court and plead guilty because the penalties are very stringent and you have options. One important penalty of reckless driving in Michigan is that you will lose your driving privileges for 6 months. Additionally, you will receive a letter from the Michigan Department of Treasury to pay Driver Responsibility Fees (DRF) for 2 years in a row.
If you have been charged with Reckless Driving Misdemeanor Ticket, contact us immediately. We can help you fight your reckless driving charge and get back on the road.
Reckless Driving is a defendable charge because it is difficult for the police officer, Prosecutor or City Attorney to show that the 'wanton' or 'willfulness' element of the statute as discussed above.
